ORDINANCE No. 177066

*Accept one tax-foreclosed property in North Portland from Multnomah County for park and recreation purposes. (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

 1. Before it offers tax-foreclosed land for sale to the public, Multnomah County offers property to jurisdictions within its boundaries if the land can be put to appropriate public use.

2. Portland Parks and Recreation staff has determined that one small parcel, currently available, is suitable for future city park and recreation use. The land is a 0.01-acre vacant parcel located within unbuilt public right of way that lies between Pier and Chimney Parks. Legal description of the parcel is Section 01BB, 1N, 1W, Tax Lot 1100. Given the small size of the site, Parks will be able to absorb maintenance cost of the land within existing appropriations.

3. The City's use of the parcel will be for future park or trail development. There is no monetary consideration for acquisition of the parcel. Should the parcel be used for something other than public purposes, title will revert to the County.

4. The Director of Portland Parks and Recreation recommends that the City accept ownership and responsibility for the parcel.

NOW THEREFORE, the Council directs:

a. The Commissioner of Public Utilities to execute a deed acknowledging the City's acceptance of the property described as Tax Lot 1100 of Section 01BB, 1N, 1W in Multnomah County and to include the parcel in the City's Chimney Park inventory.

Section 2. The Council declares that an emergency exists because a delay in accepting the property may cause the County to offer the property to other potential owners and other ownership of the parcel may create future use conflicts; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
