*Pay claim of Catherine Georgeton. (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. Catherine Georgeton is an employee of the City that has filed a workers’ compensation claim (2002-0221). The Bureau of General Services, Risk Management Division, has investigated this claim and it has been denied. This denial was appealed and pending litigation. The worker also has an accepted workers’ compensation claim for various injuries to her right knee and foot (1980-1700). She also has potential employment law claims.
2. A tentative settlement was reached at mediation and is being recommended to mitigate the City’s exposure to future costs on all pending litigation, the accepted workers compensation claim and other potential causes of action.
3. The Bureau of General Services, Risk Management Division, recommends a settlement of $37,000.00. The settlement includes a disputed claims settlement on the denied workers’ compensation claim, a claims disposition agreement on an accepted workers’ compensation claim, and a release agreement that will extinguish any potential employment claims and any future right to employment with the City of Portland.
NOW, THEREFORE, the Council directs:
a. The Bureau of General Services, Risk Management Division are hereby authorized to draw and deliver checks in the total amount of $32,000.00 made payable to Catherine Georgeton and her attorney, L. Leslie Bush for the settlement of the Workers Compensation claims.
b. The Bureau of General Services, Risk Management Division will execute payment authorizations in amounts not to exceed that set forth in sub-paragraph (a) above.
c. The Bureau of General Services, Risk Management Division is hereby authorized to draw and deliver a check in the amount of $5,000.00 made payable to Catherine Georgeton and her attorney, Tom Spaulding for the settlement of potential employment claims.
d. The Bureau of General Services, Risk Management Division will execute a payment authorization in the amount set forth in sub-paragraph (c) above.
Section 2. The Council declares that an emergency exists in order to avoid undue and costly delay in settling these claims and lawsuit; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
