AMENDMENT NO. 13
AGREEMENT FOR PROFESSIONAL SERVICES
CITY/PSI AGREEMENT
This Amendment made the ____ day of __________ 2002, modifies the Agreement for Professional Services between the City of Portland (City) and Portland Streetcar, Inc. (PSI or Contractor) dated October 2, 1997, City Agreement No. 31428 (Agreement).
RECITALS
Whereas, the Central City Plan calls for an inner-City rail transit loop with the objective of linking both East and Westside destinations within the Central City; and
Whereas, at the PSI Board meeting on March 6, 2001, following a discussion of possible future extensions of the Streetcar line, including to the Eastside, Michael Powell volunteered as the Chair of the Future Streetcar Committee; and
Whereas, on February 20, 2002, Congressman Earl Blumenauer convened a meeting of PSI Board members (Magnusen, Carroll, Powell and Pernsteiner), Eastside representatives and City representatives to discuss possible extensions of the Streetcar to the Eastside and possibilities for federal funding of its design and construction, including a proposal to create a special Streetcar funding category in the FY 2002-3 Federal Transportation Appropriations Act; and
Whereas, over the past 18 months Michael Powell reported this meeting and other meetings where Eastside representatives expressed interest and support for extending the Streetcar across the Broadway Bridge to the Lloyd District and/or the Hawthorne Bridge to the Eastside Industrial Area; and
Whereas, an Eastside Streetcar line has been incorporated as a key element in the Lloyd District Development Strategy calling for the development of a transit Hub, which strategy is supported by the Lloyd Transportation Management Association (TMA) and the Lloyd Business Improvement District (BID); and
Whereas, at its August 2, 2002 meeting, the PSI Board approved a motion directing staff to pursue contractual arrangements and funding for a study to explore the possibility of an Eastside extension; and
Whereas, the BID requested that PDC commit $100,000 in budgeted funds within the Oregon Convention Center Urban Renewal Area for a study to explore the possibility of an Eastside extension; and
Whereas, the BID has budgeted $50,000 for a study to develop a conceptual Eastside Streetcar alignment; and
Whereas, PDOT is willing to provide $25,000 in budgeted GTR resources to assist in funding a study to develop a conceptual Eastside Streetcar alignment; and
Whereas, PDC and PDOT have negotiated a scope of services and budget for the ESAS and, on October 9, 2002, PDC received commission approval of an interagency agreement with PDOT for carrying out the ESAS; and
Whereas, PDOT would like PSI to carry out project management services, operations analysis, land use analysis and community outreach services related to the ESAS.
AGREEMENT
1. Scope of Services. PSI, through its consultants, Shiels Obletz Johnsen and Peter Finley Fry, shall provide the services described in the Scope of Services attached to this Amendment as Exhibit A.
2. Total Maximum Compensation. Total Maximum Compensation provided for in the Agreement shall be increased by the amount of $50,000, in accordance with the Budget as described in Exhibit B to this Amendment.
3. Amendments to the consultant agreements and the related detailed scope of services and compensation shall be subject to review and approval of the City Project Manager prior to PSI incurring any cost for these services.
4. ALL OTHER PROVISIONS OF THE AGREEMENT REMAIN UNCHANGED.
