ORDINANCE No. 177046

 

 

 *  Amend agreement with Providence Health Systems for respiratory evaluations for Portland Fire and Rescue employees, extend the timeline and provide for payment (Ordinance; amend Contract No. 33011)

 

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  Portland Fire & Rescue (PF&R) must provide medical evaluations for all sworn employees to determine their ability to use a respirator as outlined by the Oregon Occupational Health Administration (OR/OSHA).

 

2.  OR/OSHA, Statute OAR 437, Division 2 1910.134(4/98) requires that in any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures.

 

3.  In June 2000, PF&R followed the requirements of City Code Chapter 5.68 in advertising, interviewing respondents, and using a selection committee to make the decision to contract with Providence Health Systems (PHS) for $25,000 until June 30, 2001.

 

4.  In September 2001, the PF&R extended the contract until June 30, 2002, and added $25,000 to the contract for a total not to exceed $50,000.

 

5.  It is necessary and advisable to extend that contract, No 33011, until June 30, 2003.

 

6.  Funding for this service is included in PF&Rs FY 02-03 budget.

 

7.  Amendment No. 3 to Contract # 33011 is attached, signed by the contractor and approved as to form by the City Attorney.

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner in Charge and Auditor are authorized to execute an amendment to Contract No. 33011 with Providence Health Systems, attached hereto as Exhibit A.

 

 

 

b.  The Commissioner in Charge and the Auditor are authorized to draw and deliver checks chargeable to the FY 2002-03 Budget, Account 521000, Center Code 12430250, when demand is presented and approved by proper authorities.

 

Section 2. The Council declares that an emergency exists because the contract has already expired; therefore, this ordinance shall be in force and effect from and after its passage by the Council.
