ORDINANCE No. 177030
*Authorize the donation of three vehicles to Portland School District No. 1. (Ordinance).
The City of Portland ordains:
SECTION 1. The council finds:
1. The City of Portland and Portland School District No. 1 completed an Intergovernmental Agreement to provide for the City’s supervisory services to the District’s police operations in 1999.
2. In July 2001 (Ordinance No. 175755), the City Council authorized an amendment to the Intergovernmental Agreement, transferring police vehicles and the responsibility for school police operations to the City of Portland.
3. The amended Intergovernmental Agreement included the transfer of police vehicles from the District to the City.
4. As appropriate, some of the vehicles were placed in City police service and some were sold to provide funds for the replacement of police vehicles.
5. The District has requested the return (donation) of three of the vehicles determined by the City’s Bureau of Police and Vehicle Services to not be appropriate for City police patrol usage.
6. The District plans to use the donated vehicles for their student driver-training and Crime Stopper programs.
7. City Code (5.36.011) explains that the City has historically limited donations because the revenue from sale of the vehicles is used for the purchase of replacement vehicles, however, some donations in the public interest are appropriate.
8. The Code requires donations of property with a market value greater than $2,500 to receive the approval of the City Council.
9. The City has determined that the current market value of each of the three vehicles is greater than $2,500.
NOW, THEREFORE, the Council directs:
a. Three vehicles currently owned by the City of Portland (SP-10: 1995 Chevrolet Caprice, SP-15: 1996 Ford Crown Victoria, SP-17: 1996 Ford Crown Victoria) are not required by the City, and shall be donated to Portland School District No. 1.
b. The donation is in the public interest and will benefit social and educational activities, and Portland School District No. 1 must agree to hold the City harmless from all claims arising from the donation of the three vehicles.
Section 2. The Council declares that an emergency exists because delay in proceeding with this donation will unnecessarily deprive Portland Public School District No. 1 of the social and education benefits of the vehicles; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
