ORDINANCE NO. 177023

*Accept a $39,660 grant from the Oregon Association Chiefs of Police and Oregon Department of Transportation

 for safety belt enforcement (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  The Oregon Dept. of Transportation (ODOT) Traffic Safety Division has made grant funds available through the Oregon Association Chiefs of Police (OACP) Three Flags again this year. The grant funds are for safety belt enforcement.

2.  The Portland Police Bureau Traffic Division will participate in the Three Flag blitz events and use the grant for on-going enforcement on an overtime basis.

3.  The Oregon Department of Transportation agrees to reimburse the Portland Police Bureau for overtime hours worked under this grant at a rate of $30.00/hour worked. For every hour of overtime worked for reimbursement under this grant the Police Bureau must have 2 hours of straight time during which the focus is on safety belt enforcement.

4.  This agreement shall be effective October 1, 2002 and shall terminate on September 30, 2003.  

NOW, therefore, the Council directs:

a.  The Mayor is authorized to accept a grant from the Oregon Department of Transportation for the Portland Police Bureau.

b  An increase in appropriation for FY 02/03 and transfer funds for the grant award is authorized as follows:

Section 2. The Council declares that an emergency exists in that delay in accepting this grant will deprive the City of Portland of additional law enforcement services for safety belt enforcement; therefore, this ordinance shall be in force and effect from and after its passage by the Council.
