Amendment to Lease Agreement

Amendment No. 1 to Agreement No. 51897

(Per Ordinance No. ______________)

 

We, the undersigned, agree to amend Agreement No. 51897, between the City of Portland and RedTail Inc. as follows:

 

(1)  The deadline for the lessee to submit a master plan that shall be considered relevant to Section III “Lessee’s Master Plan Option” is extended from November 1, 2002 to November 1, 2003.

 

(2)  The date by which the lessee must begin remodeling the existing pro shop (pursuant to subsection II (3) (b) “Lessee Capital Improvements”) if it does not submit a master plan is extended from October 1, 2003 to January 1, 2004.

 

(3)  The date before which the City agrees not to carry out additional development projects other than golf course improvements (pursuant to subsection III (5) “City Retains Development Rights”) is changed from July 1, 2003 to January 1, 2004.

 

(4)  The Director of Parks & Recreation is authorized to sign minor amendments to the lease agreement that may be agreed upon by the City and lessee in the future, subject to approval as to form by a representative of the City Attorney’s Office. Amendments that affect either party’s financial obligations or that change the length of the lease term shall be considered “major amendments;” all other amendments shall be considered “minor amendments.” Minor amendments shall be documented, numbered, and recorded with the City Auditor in the same manner as major amendments, which must still be approved by specific City Council action.

 

(5)  All other terms and conditions of the agreement remain the same.
