ORDINANCE No. 177001
*Authorize an Intergovernmental Agreement with the Oregon Department of Transportation, Oregon Transportation Investment Act to provide funding for the 162nd and Foster Intersection Project (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City of Portland Office of Transportation is completing construction the SE Foster Rd/SE 162nd Intersection Improvement Project which will provide a traffic signal and left turn lanes. As part of the, the Portland Office of Transportation replaced an outdated culvert with a new arch culvert that will facilitate fish passage.
2. On February 26, 2002, City Council passed Ordinance No. 176292, authorizing a contract for construction of the SE Foster Rd/SE 162nd Intersection Improvement Project.
3. The project addresses an existing safety and capacity problem at the intersection, and will significantly increase habitat for the cutthroat and coho salmon.
4. At its August meeting, the Oregon Transportation Commission agreed to provide up to $1.5 million from the Oregon Transportation Investment Act to fund the project.
NOW, THEREFORE, the Council directs:
a. The Mayor and Auditor are authorized to execute an Intergovernmental Agreement with the Oregon Department of Transportation to authorize XXXX in Oregon Transportation Investment Act funds to be directed to the SE Foster Rd/SE 162nd Ave. Intersection Improvement Project.
b.
Section 2. The Council declares that an emergency exists because a delay in executing the agreement will reduce the amount of funds available; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
