Site Analysis and Design Contract

 

This Intergovernmental Agreement is entered into this day of 2002, by and between Multnomah County (County) and the City of Portland (City) through the Office of Transportation (PDOT).

 

RECITALS

 

This Intergovernmental Agreement provides for the County funding of site analysis and design for a new library at Bertha Court (thereinafter referred to as the “Project”). PDOT staff will perform the site analysis and design work.

 

The total cost of this project is not to exceed $66,483.46.

 

All necessary funds for the project will be provided by the County, in accordance with this Agreement.

 

AGREEMENT

 

l. FUNDING

 

The County shall pay to PDOT a sum of Sixty-Six Thousand, Four Hundred Eighty-Three Dollars and Forty-Six cents ($66,483.46) for all labor and associated costs related to the Project.

 

II. PDOT SCOPE OF WORK

 

PDOT shall be responsible to provide a site analysis and design within the area of Bertha Blvd. and Capitol Highway, moving Bertha Court to facilitate a larger site for a new County library. Items of work include:

 

Project Management of preliminary engineering. Lead community process for design. Attended all public meetings. Coordinated and communicated with Multnomah County, consultants and other agencies. Management of project design, budget, schedule, and community involvement.

 

Civil Design for the realignment of Bertha Court, including a new intersection at Beaverton-Hillsdale Hwy and realignment of the intersection at Bertha Blvd. Civil design included sidewalk, bike lanes, transit stops, driveway approaches, parking lot adjustments and stormwater drainage.

 

Extensive traffic analysis to determine the feasibility of modifying the Capitol Hwy and B-H Hwy signalized intersections. Conceptual design includes options pertaining to signal modifications.

 

Survey Bertha Court, Vermont, Capitol Hwy, 18th and Bertha Blvd. to

determine Right of Way. Resolve ROW maps and deliver base and topography maps and legal descriptions.

 

PDOT Civil Engineer to review retaining wall design.

 

Prepare city ordinance for vacation of Bertha Court.

 

 Prepare Signal and Street Lighting analysis.

 

Prepare Environmental site evaluation

 

III. COMPENSATION

 

The County shall pay PDOT for work based on actual costs for staff and reimbursable not to exceed $66,483.46.

 

IV. EFFECTIVE AND TERMINATION DATES

This Intergovernmental Agreement shall be effective retroactively to November 1, 1999. Project will terminate upon final payment by Multnomah County.

 

V. PROJECT MANAGERS

The project manager for Portland Office of Transportation is Joanna Guzzetta and the project manager for Multnomah County is Mike Harrington.

 

VI. COMPLIANCE WITH THE LAW

In connection with its activities under this Agreement, the parties shall comply with all applicable federal, state and local laws and regulations.

 

VII. INDEMNIFICATION

PDOT and the County shall each be solely responsible for any loss or injury caused to third parties arising from PDOT’s or County’s own acts or omissions under this Agreement, and PDOT or the County shall defend, hold harmless, and indemnify the other party of the Agreement with respect to any claims, litigation, or other liability arising from PDOT’s or the County’s own negligent acts or omissions under this Agreement.

 

VIII. AMENDMENT TO AGREEMENT

There will be no amendments to this Agreement by the County or PDOT.

 

 

IN WITNESS OF, the City of Portland, through the Portland Office of Transportation and Multnomah County have executed this Agreement as of the date first written above.
