The City of Portland ordains:

Section 1.  The Council finds:

1.  The City of Portland Office of Transportation completed a site analysis and design to vacate Bertha Court in order to facilitate a larger site for a new library.

2.  Multnomah County requested the Portland Office of Transportation expedite this analysis and design in order to keep the project on schedule.

3.  The project addresses the realignment of Bertha court, including retaining wall design, street lighting, storm water management and environmental evaluation.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities and the Auditor are hereby authorized to enter into an Intergovernmental Agreement with the Multnomah County, similar in form to the agreement attached to the original of this ordinance, and by this reference made a part hereof.

Section 2.  The Council declares that an emergency exists because delay in executing this agreement will delay use of funds needed on existing projects; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
