ORDINANCE No. 176997

*Amend contract with Suburban Propane Limited Partnership for furnishing propane gas supplies to various City bureaus (Ordinance; Amend Contract No. 40401)

The City of Portland ordains:

Section 1.  The Council finds:

1.  Ordinance No. 171385, passed on July 16, 1997, authorized the purchase of propane gas through the Portland Public Schools Price Agreement and the execution of a contract with Suburban Propane Limited Partnership in accordance with ORS 279.150 for a period of five years. This contract recently expired.

2.  The Portland Public Schools Price Agreement remains in effect until June 30, 2003. The specifications for this joint procurement included the total estimated annual supply requirements of both Portland Public Schools and City of Portland bureaus. The contract prices are based on a large volume and have been updated to take advantage of price adjustments; the prices, therefore, are competitive.

3.  In order to continue receiving the volume price benefits of the Portland Public Schools Price Agreement, it is in the best interest of the City to extend the current contract with Suburban Propane Limited Partnership for an additional term for an estimated amount of $30,000.

4.  It is prudent to authorize the Purchasing Agent to extend this contract for an additional term through June 30, 2003.

NOW, THEREFORE, the Council directs:

a.  The Purchasing Agent is hereby authorized to execute a contract amendment to extend this contract through June 30, 2003.

b.  The Mayor and Auditor are authorized to draw and deliver warrants chargeable to the appropriate budget when demand is presented and approved by the proper authorities.

Section 2.  The Council declares that an emergency exists because a delay will prevent City bureaus from continuing to receive the contract pricing; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
