ORDINANCE 176992

 

*Extension to contract with Tonkin Torp, LLP for outside counsel requirements.

(Ordinance, Legal Service Agreement No. 34446)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The City requires the services of outside legal counsel to assist in trial of the various claims from the Water Bureau contract with Severn Trent Systems.

 

2.  The law firm of, Tonkin Torp, LLP (Counsel) has agreed to provide these services by Legal Service Agreement No. 34446.

 

3.  Due to the complexity of the issues and the magnitude of the claims, expenditures for outside counsel will exceed that previously authorized by Council. It is necessary to extend the legal services agreement in the amount of $75,000 in order to authorize and continue payment.

 

NOW, THEREFORE, the Council directs:

 

a.  The City Attorney is authorized to extend Legal Service Agreement No. 34446, dated September 11, 2002, to provide for representation by outside counsel in an additional amount of $75,000, for a total amount not to exceed $125,000.

 

b.  If applicable, the provisions of City Code Chapter 5.68 are waived.

 

c.  The Mayor and Auditor are authorized to draw and deliver warrants in payment of legal services provided under this Legal Services Agreement chargeable to Center Code 18089961/ Project #3457/Account No. 521000.

 

Section 2. The Council declares that an emergency exists in order to pay for legal services necessary in the matter of Severn Trent Systems, therefore, this ordinance shall be in full force and effect from and after its passage by Council.
