ORDINANCE No. 176990
* Authorize Wireline Crossing Agreement with Union Pacific Railroad Company (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City requires access to property owned by Union Pacific Railroad Company for the purpose of constructing and maintaining a fiber optic wireline crossing for the Integrated Regional Network Enterprise (IRNE) project.
2. Union Pacific Railroad Company is willing to grant the City such access under the terms and conditions provided in the agreement attached hereto as Exhibit 1.
NOW, THEREFORE, the Council directs:
a. The Chief Administrative Officer or his designee, the Director of the Bureau of Communications and Networking, is authorized to execute the agreement attached hereto as Exhibit 1.
b. The Mayor and the Auditor are authorized to draw and deliver a check in the amount of $3100.00 to Union Pacific Company as a one time payment for the required access.
Section 2. The Council declares that an emergency exists in order that there be no delay in the construction and operation of the wireline; therefore, this Ordinance shall be in full force and effect from the date of its passage by the Council.
