Amend fee schedules for certain Site Development fees on all construction permits to cover Office of Planning and Development Review plan review and inspections services (Ordinance)

The City of Portland Ordains:

Section 1. The Councils finds:

1.  Fees collected under the building and other permit fee schedules are used to pay for administering and enforcing the non-structural aspects of all construction in the City, including drainage and stormwater management, development in the floodplain and slope hazard areas, grading, private streets, site preparation, landscaping and trees and erosion control fees. These fees also fund compliance with Land Use review conditions of approval and development standards in environmental zones.

2.  A variety of fees for residential projects are being consolidated into a flat rate site development fee. Fees listed separately as erosion control, on site stormwater facility inspection, stormwater disposal plan review and tree preservation plan review and inspection are being combined into a single residential fee for all site development services. This simplifies the fee structure, provides predictability and assures consistent rates for our residential customers. The 2-tiered flat rate is based upon the complexity of the site and accompanying reviews and inspections required due to site constraints such as zoning overlays, steep slope, earthquake hazard areas and lots larger than 10,000 square feet.

3.  All commercial building projects will see a 5.1% increase in the erosion control and the stormwater facility inspection fees currently charged on building permits.

4.  Site development permit fees for work not associated with a structure will increase by 5.1%.

5.  These adjustments to our current fee structures for site development services will allow the Office of Planning and Development Review to more closely achieve cost recovery while providing quality services to ensure the City goals are met for all non-structural development standards.

NOW THEREFORE, The Council directs:

a.  The attached fee schedule listed as Exhibit A is hereby adopted.
