ORDINANCE No. 176974

* Authorize the execution of Intergovernmental Agreement with the City of Milwaukie for the Springwater Corridor Three Bridges Section. (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  The City of Portland (Portland) and the City of Milwaukie (Milwaukie) have identified the Springwater Corridor Trail as a Regional Trail.

2.  Portland and Milwaukie have cooperated since 1992 to create over 15 miles of the Springwater Corridor, a multi-use trail.

3.  The Three Bridges Section is an undeveloped section of the Springwater Corridor Trail, approximately 0.6 miles in length, partially located both in the City of Portland and the City of Milwaukie.

4.  Portland and Milwaukie wish to enter into this Intergovernmental Agreement (IGA) to set forth the responsibilities and obligations of the parties as they relate to the participation, funding, design, construction, ownership, operation, and maintenance of the Three Bridges Section of the Springwater Corridor Trail.

5.  Portland and Milwaukie acknowledge that they have authority to enter into IGA this pursuant to the powers contained in their respective charters and in ORS 190.010; conditions mutually agreeable to the contracting parties.

NOW, THEREFORE, The Council Directs:

a.  The Commissioner in charge of Portland Parks and Recreation is authorized to execute the intergovernmental agreement, substantially similar to that attached hereto as Exhibit A, with the City of Milwaukie in order to allow the performance of work on the Springwater Corridor Three Bridges, when approved by the City Attorney.

Section 2.  The Council declares an emergency exists because the work must commence immediately to be completed within given deadlines, and allow the use and enjoyment by the public; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
