ORDINANCE No. 176972

* Extend contract with Byron Wood Enterprises for concession services at Heron Lakes Golf Course (Ordinance; amend Contract No. 50989).

The City of Portland ordains:

Section 1.  The Council finds:

1.  The City entered into Contract No. 50989 with Byron Wood Enterprises for concession services and operation of the golf facilities at Heron Lakes Golf Course on October 30, 1997. Said contract will expire on October 30, 2002. By City Code, a contract of this nature may be extended for one additional term, not to exceed the term of the original contract.

2.  Portland Parks & Recreation is satisfied with the concession operation under this contract and feels that it would be advantageous for the City to extend said contract. The Golf Advisory Committee has also recommended to the Director of Portland Parks & Recreation that this contract be renewed.

3.  Following the recent death of Byron Wood, the other co-owner of Byron Wood Enterprises, Barbara Wood, has committed to continue the operation of the Heron Lakes clubhouse concession, using the existing management team plus the addition of a new partner, Troy Wood. The Director of Parks & Recreation recommends that this management team be allowed to continue providing service to the Heron Lakes golfing public.

NOW, THEREFORE, the Council directs:

 a.  Contract No. 50989 with Byron Wood Enterprises for concession services at Heron Lakes Golf Course hereby is extended through December 31, 2007.

 b.  The Mayor and the Auditor are hereby authorized to draw and deliver warrants chargeable to Portland Parks & Recreation when demand is presented and approved by the proper authority.

Section 2.    The Council declares that an emergency exists, because delay in proceeding with the contract extension would unnecessarily deprive the City of the benefits of the services covered by the contract; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
