ORDINANCE No. 176968

 

*Dedicate and assign a strip of Bureau of Fire, Rescue and Emergency Services land as public street right-of-way. (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  Additional right-of-way is needed in connection with the improvement of NE Sandy Blvd. in conjunction with the construction of Fire Station 28, to be located at 5540 NE Sandy Blvd.

 

2.  The Bureau of Fire, Rescue and Emergency Services owns property needed for this purpose.

 

3.  The Bureau of Fire, Rescue and Emergency Services agrees to dedicate and assign a portion of its land as public street right-of-way.

 

4.  There is no financial impact to any bureau by the assignment of this small strip of land to street right-of-way area.

 

NOW, THEREFORE, the Council directs:

 

a.  The following described City-owned land under the jurisdiction of the Bureau of Fire, Rescue and Emergency Services is hereby dedicated and assigned as public street right-of-way:

 

A portion of Lot 1, Block 77, Rose City Park, situated in the Northeast ¼ of Section 30, Township 1 North, Range 2 East, Willamette Meridian, City of Portland, Multnomah County, Oregon, being more particularly described as follows:

 

Commencing at a found iron rod monumenting the southeast corner of Lot 2, Block 77, Rose City Park, said point being on the westerly right-of-way line of N.E. 56th Avenue and 30.00 feet westerly from the centerline of N.E. 56th Avenue, when measured at right angles; thence North 00º00’36” East along said westerly right-of-way line a distance of 115.67 feet, more or less, to its intersection with the southeasterly right-of-way line of N.E. Sandy Boulevard, said point of intersection being 40.00 feet southeasterly from the centerline of N.E. Sandy Boulevard, when measured at right angles, and the Point of Beginning.

 

Thence South 60º24’06” West along said southeasterly right-of-way line a distance of 115.02 feet, more or less, to a point on the westerly line of said Lot 1;

thence South 00º00’36” West along the westerly line of said Lot 1 a distance of 2.30 feet to a point;

thence North 60º24’06” East parallel with and 2.00 feet southeasterly of said southeasterly right-of-way line, when measured at right angles, a distance of 109.82 feet to a point;

thence South 59º47’39” East a distance of 5.23 feet to a point on said westerly right-of-way line;

thence North 00º00’36” East along said westerly right-of-way line a distance of 7.50 feet to the Point of Beginning.

 

Said described tract of land contains 242 square feet, more or less, subject to all existing easements and rights-of-way.

 

b.  That the Auditor shall record a certified copy of this Ordinance in the Multnomah County Deed Records, and return one recorded copy to the Right-of-Way Acquisition Section, Transportation Engineering and Development, Office of Transportation, City of Portland, and one copy to Diana Lee Holuka, Property Manager, Bureau of General Services.

   

Section 2. The Council declares that an emergency exists because a delay in designating and assigning land as right-of-way may cause delays to the construction of Fire Station 28, an essential facility for the citizens of the City of Portland; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
