FIRST AMENDMENT

 

This First Amendment is effective the _____ day of ­­­­­September, 2002 between SALVATION ARMY and THE CITY OF PORTLAND, a municipal corporation.

 

The Salvation Army and the City of Portland entered into a Contract for Use of Camp Facilities at Camp Kuratli effective the first day of September, 2002 for lease of premises located at 24751 SE Highway #224, Boring, Oregon. The site is also known as Camp Kuratli.

 

IT IS AGREED:

 

1.  The Contract for Use of Camp Facilities shall include compensation to the Salvation Army of not more than One hundred seventy-five thousand dollars ($175,000).

 

2.  The premises at Camp Kuratli shall include a full-time classroom; use of other classrooms as agreed between the Salvation Army and the City of Portland, Police Corps; dormitories for housing attendees; grounds to be used by Police Corps Academy attendees; and other areas used during Police Corps academies during the Contract term, as approved by the Salvation Army. In addition, the Salvation Army shall provide administrative office space for the Police Corps program on a full-time basis during this Contract.

 

3.  Costs for classroom and other facilities shall be:

Classrooms and associated facilities    $1,100 per month

Office space           $ 800 per month plus pro rated utility costs

Meals:    Breakfast  $6.75 per person

     Lunch    $7.75 per person

     Dinner    $9.25 per person

     Brunch    $8.25 per person

Graduation ceremony    $12.00 per person

4.  The section titled “Number of Full Time Attendees” is modified to provide that the City confirms twenty-four (24) full time attendees as of the date of this amendment.

 

5.  The section titled “Food and Drink” on page two of the Contract for Use of Camp Facilities, is deleted and replaced with the following:

 

The City of Portland shall be responsible for the quality and condition of all foods brought onto the premises by the City, its officers, agents or employees. To the extent permitted by the Oregon Constitution Article XI, § 9, and the Oregon Tort Claims Act, ORS 30.260, et. seq., the City of Portland agrees to indemnify, defend and hold harmless the Salvation Army harmless against all claims, losses, damages, costs and expenses arise out of the negligent acts or omissions of the City of Portland, its officers, agents or employees.

 

6.  The section titled “Indemnification and Hold Harmless Agreement” on page two of the Contract for Use of Camp Facilities is deleted and replaced with the following:

To the extent permitted by the Oregon Constitution Article XI, § 9, and the Oregon Tort Claims Act, ORS 30.260, et. seq., the City of Portland agrees to indemnify, defend and hold harmless the Salvation Army harmless against all claims, losses, damages, costs and expenses arise out of the negligent acts or omissions of the City of Portland, its officers, agents or employees.

 

 

7.  The section titled “Insurance” on page two of the Contract for Use of Camp Facilities is revised to acknowledge that the City of Portland is self-insured, and that if the City of Portland is no longer self-insured, it shall provide liability insurance as stated in this section.

 

8.  The section titled “Facility Rules and Regulations” is revised to provide that the Rules & Regulations for Camp Rental Groups is attached as Exhibit A to the First Amendment.

 

9.  The Rules & Regulations for Camp Rental Groups, Exhibit A, is revised to provide that City of Portland employees, officer, agents, contractors and invitees shall not be proselytized.

 

10.  The Rules & Regulations for Camp Rental Groups, Exhibit A, is revised to provide that items 3. and 4. of the Rules & Regulations are deleted.

 

11.  The Salvation Army Mission Statement is included in the attached Exhibit A.

13.  All other terms and conditions of the Contract for Use of Camp Facilities shall remain the same.
