ORDINANCE No. 176886

*Agreement with Oregon Department of Transportation to provide for the replacement of the SW Champlain St. Semi-Viaduct structure, Bridge No. 25B34 (Ordinance)

The City of Portland ordains:        

Section 1.  The Council finds:

1.  The SW Champlain St. Semi Viaduct structure (Bridge # 25B34) is in deteriorated condition and is functionally obsolete. Design of its replacement has been approved as a project using the 2001 Oregon Transportation Investment Act (OTIA) funds.

2.  This Project is funded 100% by the 2001 Oregon Transportation Investment Act Program.

3.  The Project will be in the preliminary engineering (plan development) stage during FY 02/03 with construction tentatively scheduled for FY 04/05.

4.  Oregon Department of Transportation (ODOT) has prepared an Agreement for City approval and execution.  

NOW, THEREFORE, the Council directs:

a.  The Mayor and Auditor are hereby authorized to enter into an agreement, similar in form to the agreement attached to this ordinance, and by this reference made a part hereof.  

Section 2. The Council declares that an emergency exists because delay in executing this agreement would delay construction and the related benefits to be derived from completion of this project; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
