ORDINANCE NO. 176875

Amend contract with Cornforth Consultants, Inc. to extend the contract time for professional

engineering services. (Ordinance; amend Contract No. 30891).

The City of Portland ordains:

Section 1. The Council finds:

1.  The City entered into Contract No. 30891 on October 10, 1996 with Cornforth Consultants, Inc. to provide professional services for a feasibility study and a preliminary engineering report to relocate the Sandy River water supply conduit overcrossings into undercrossings.

2.  Bureau and Cornforth project participants have completed the feasibility study and 90% of the preliminary engineering report. The City delayed completion of the work on this project since the events of September 11. Our project management resources were reallocated to work on higher priority projects and focused on security related projects. The Bureau now requires completion of the preliminary engineering report. However, the contract time needs to be extended.

3.  The original contract completion time of October 30, 1997 was extended through prior amendments. Completion of the preliminary engineering report is now scheduled through December 31, 2004.

4.  City Charter Section 2-105(a)(3) provides that non-property contracts shall not exceed five (5) years unless extended or renewed by City Council for up to an additional five (5) years. The initial five (5) year period for this contract expired October 10, 2001. In order to complete these needed services it is necessary for City Council to authorize an extension of this contract through December 31, 2004.

5.  Any applicable provisions of PCC Section 5.68 must be waived for this contract and extension.

6.  All other terms and conditions of Contract No. 30891 remain the same.

NOW, THEREFORE, The Council directs:

a.  That the Commissioner of Public Affairs and Auditor are authorized to execute on behalf of the City an amendment to Contract No. 31302 between the City and Tetra Tech/KCM Inc. as outlined in attached Exhibit 1, attached to original ordinance only.

b.  Agreement for Services with Cornforth Consultants, Inc., Contract 30891 dated October 10, 1996, including Amendment Nos. 1 through 6, are hereby extended through December 31, 2004.

c.  Any applicable provisions of PCC Section 5.68 are hereby waived for this contract and extension.
