ORDINANCE No. 176873

*Amend Interagency Agreement with Portland Development Commission for 2002-2003 professional and technical services for transportation improvements (Ordinance; amend

Contract No. 51819)

The City of Portland ordains:

Section 1.  The Council finds:

1.  On July 3, 2002, City Council passed Ordinance No. 176642 authorizing an interagency agreement for FY 2002-2003 for professional and technical services for transportation projects in urban renewal areas.

2.  On July 10, 2002, the Portland Development Commission (PDC) passed Resolution No. 5890 authorizing additional scopes of work and increased funds for the Broadway Weidler Corridor Phase III Local Improvement District Exploration Project, the Lents Town Center Residential Street Improvement Program and the Burnside Transportation & Urban Design Plan.

3.  On August 14, 2002, PDC passed Resolution No. 5912 authorizing additional scopes-of-work for Downtown Waterfront Development Opportunities and the Portland Streetcar Extension to RiverPlace.

4.  The Portland Office of Transportation (PDOT) and PDC wish to add the work called for in PDC Resolution Nos. 5890 and 5912 to the Interagency Agreement and to increase the total compensation to PDOT to an amount not to exceed $6,629,119.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities, the Auditor and the Director of the Portland Office of Transportation are hereby authorized to amend the Interagency Agreement, similar in form to the agreement attached to the original of this Ordinance, and by this reference made a part hereof.

b.  The Bureau Contract Manager is authorized to agree to and execute on behalf of the City any amendment, which does not increase the total compensation or change the length of the contract term, with the mutual consent of the PDC Contract Manager.

Section 2.  The Council declares that an emergency exists because a delay in executing the amendment to this Interagency Agreement will adversely impact the City’s ability to meet the design and construction schedules for the included projects; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

Passed by the Council, AUG 28 2002
