ORDINANCE NO. 176871
* Extend the agreement with the Tri-County Metropolitan Transportation District of Oregon whereby the Portland Police manages the Tri-Met Transit Police Division. (Ordinance; amend Contract
No.51484)
The City of Portland ordains:
Section 1. The Council finds:
1. The Police Bureau has an agreement with Tri-Met whereby the Police Bureau manages the Tri-Met Transit Police. This agreement is known as the “Prime Agreement”.
2. The Tri-Met Transit Police Division is a multi-jurisdiction program that includes sworn officers from the City of Beaverton Oregon, City of Gresham Oregon, City of Milwaukie Oregon, Multnomah County Oregon and Washington County Oregon.
3. Concurrent with the “Prime Agreement” agreements are being individually executed between Tri-Met, the City of Portland, the three cities and two counties. These agreements are included in the Prime Agreement by reference.
4. On an annual basis the parties to the agreements will agree upon the level of police service including personnel, equipment, and related support to be provided to Tri-Met. Portland, Beaverton, Gresham, Milwaukie, Multnomah County and Washington County officers and personnel assigned to the Tri-Met Transit Police will remain employees of their respective agencies and shall not be considered employees or agents of Tri-Met.
5. To assist the Tri-Met Transit Police in the performance of their duties Portland will provide them with access to the Portland Police Data System at no cost.
6. Portland shall bill Tri-Met for all police services provided by Portland, Beaverton, Gresham, Milwaukie, Multnomah County and Washington County quarterly.
7. Beaverton, Gresham, Milwaukie, Multnomah County and Washington County shall bill Portland for their services monthly.
8. The term of this amendment is from July 1, 2002 to June 30, 2005. Thereafter this agreement may be renewed for additional term(s) up to two years upon agreement of both parties.
NOW, therefore, the Council directs:
a. The Mayor and City Auditor are hereby authorized to amend contract 51484 between the City of Portland and the Tri-County Metropolitan Transportation District of Oregon attached as Exhibit A.
Section 2. The Council declares that an emergency exists because delay in proceeding with this agreement will unnecessarily deprive the City of Portland and Multnomah County of the mutual benefits of this agreement; therefore this ordinance shall be in force and effect from and after its passage by the Council.
