ORDINANCE No. 176870

*Authorize appointment of Tod Burton to the position of Economist I at a rate of pay of $31.76 per hour. (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  In accordance with the Human Resources Administrative Rule 7.7, the Bureau of Financial Services offered reinstatement of employment to Tod Burton effective August 1, 2002.

2.  Pursuant to the provisions of reinstatement, Mr. Burton was offered a salary rate of $31.76 per hour, the top of range for Economist I.

3.  The offer of employment was inadvertently based on inaccurate information as to Mr. Burton’s placement in the salary range when he resigned employment from the City.

4.  Mr. Burton accepted the City’s offer of employment in good faith and tendered his resignation with his employer.

5.  The error in salary was discovered when the Bureau of Human Resources was

processing his Personnel Action Notice.

6.  It is prudent and in the best interests of the City to pay Mr. Burton the salary

contained in the offer of employment upon which he based his decision.

NOW, THEREFORE, the Council directs:

a.  Mr. Burton is hereby appointed to the classification of Economist I at the hourly

rate of $31.76 effective August 1, 2002.

b.  Future salary adjustments will be made in accordance with the City’s Compensation Plan and policies.

Section 2. The Council declares that an emergency exists in order that Mr. Burton may

receive the rate of pay he was offered and upon which he based his decision to

return to the City of Portland; therefore, this Ordinance shall be in force and effect

from and after its passage by the Council.
