ORDINANCE No.  176869 AS AMENDED

 

* Amend Code relating to taxicab regulations by reforming and renaming the Taxicab Board of Review (Ordinance; amend Code Chapter 16.40; replace 16.40.110)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

1.  Portland City Code Chapter 16.40, Taxicab Regulations, is in the process of being fully revised to better reflect the regulatory role of the City in the private for hire transportation industry. It will take a considerable amount of time to complete the full revision.

2.  In the meantime, it is in the interest of the City and the private for hire transportation industry to make an interim revision to PCC 16.40.110.

3.  Currently, the Taxicab Board of Review does not have any representation from the limited passenger transportation segment of the private for hire transportation industry. The City recently enacted regulations for this segment of the private for hire transportation industry and it is appropriate for that segment of the industry to have representation on the Board.

4.  Currently, the taxicab segment of the private for hire transportation industry is represented by two non-voting representatives on the Board.

5.  To better reflect the composition of the private for hire transportation industry, and to give all segments of the industry significant voices on the Board, the Taxicab Board of Review has recommended reconstituting the Board. The new Board will have nine voting members. Most of the current positions on the Board will remain the same. However, the new Board composition will eliminate the driver representative and the non-voting taxicab company representatives and will provide for one voting representative from all the permitted private for hire transportation companies and one voting representative from all the permitted private for hire drivers.

6.  The new Board will be named the Private For Hire Transportation Board of Review in recognition of the broader scope of the new Board.

7.  Representatives of permitted companies, and all drivers that chose to participate, shall compose standing committees that will be responsible for selecting the representatives to the Board and for bringing issues concerning permits, standards and enforcement to the Board for consideration and determination. The standing committees will be composed of members from the taxicab, executive sedan, shuttle and specially attended transportation segments of the industry.

8.  At this time it is also in the interest of the City and the industry to provide for staggered terms for Board representatives.

Section 2.  NOW, THEREFORE, the Council directs:

a.  PCC 16.40.110 is replaced as provided by Exhibit 1.

b.  If any of the provisions of this amendment conflict with the remaining sections of PCC Chapter 16.40, or regulations previously adopted by the Board, the conflicting provisions shall be interpreted in accordance with the provisions of this amendment.

c.  The current Board shall continue in place until such time as the standing committees have selected their representatives and the new Board representatives are seated as provided by this amendment.

Section 3.  This Council declares an emergency because it is necessary that each segment of the private for hire transportation industry has an effective voice on the Board as soon as possible. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
