*Authorize contract with Browning Shono Architects, LLP for design services to complete the design of Columbia Boulevard Wastewater Treatment Plant DODD Building Second Floor Rehabilitation Project

The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Environmental Services (BES) has need to contract for professional design services with Browning Shono Architects, LLP to complete design of the Columbia Boulevard Wastewater Treatment Plant DODD Building Second Floor Rehabilitation Project.
2. The BES PTE Contracting Manual Procedures, Volume 2 of 2, pages 10-11, provides for the sole sourcing “when it is likely that award to any other source would result in; (A) substantial duplication of cost to BES that is not expected to be recovered through competition”.
3. Browning Shono Architects, LLP is the designer of record for the project, and the City is likely to incur substantial duplication of cost that is not expected to be recovered through competition in the event the work were to be awarded to any other source.
4. The estimated cost is $36,559. Funds are available in the Sewer System Operating Fund, FY 2002-03 Adopted Budget, Bureau of Environmental Services, Center Code 145-22-110 Project Numbers 6246, Account No. 521000.
NOW, THEREFORE, the Council directs:
a. The Commissioner of Public Affairs and Auditor are authorized to execute a contract with Browning Shono Architects, LLP for the purpose described in Section 1, in the amount of $36,559.
b. The Chief Engineer of the Bureau of Environmental Services shall be authorized to approve changes to the contract price up to 10 percent of the total contract amount.
c. That the City’s Project Manager may execute any amendments not increasing the cost ceiling.
d. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Approved Sewer System Operating Fund, FY 2002-2003 when demand is presented and approved by the proper authority.
Section 2: The Council declares an emergency that an emergency exists because time is of the essence to complete the design and subsequent construction of the project. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
