ORDINANCE NO. 176862

 

*Amend contract between the Bureau of Waterworks and the City of Gresham for the sale of water. (Ordinance; amend Contract No. 18899)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  Ordinance # 150121 passed by Council on July 30, 1980 which authorized a 25-year agreement, Contract # 18899 dated August 11, 1980, between the Purchaser and the City for sale of water, will expire August 11, 2005.

2.  An amendment to extend the current agreement was sent to the purchaser for review and signature.

3.  Purchaser has approved and signed the amendment marked Exhibit A, attached to the original only

 

 

NOW, THEREFORE, The Council directs:

 

a.  That the Commissioner of Public Affairs and Auditor are authorized to execute on behalf of the City an amendment to the contract to extend the agreement to July 1, 2007.

b.  The contract amendment effective date shall be the date this ordinance is approved by Council

 

Section 2. The Council declares that an emergency exists because of the need for continuous water supply to the City of Gresham. Therefore, this Ordinance shall be in force and effect from and after its passage by Council.
