ORDINANCE No. 176858

*Declare surplus an unused steel loading dock located within Springwater Corridor and donate it to

the City of Gresham (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

 1. When the City acquired Springwater Corridor from Portland Traction Company, the land contained many railroad-related items. The railroad salvaged all the items it wanted, but the steel loading dock at the old Linnemann Junction area in Gresham was abandoned in place.

2. The Linnemann Junction area is now in the process of being developed by the City of Gresham into a trailhead with a small building, a parking lot and public facilities. The loading dock must be removed in order to construct the trailhead.

3. The City of Gresham has agreed to remove the loading dock, but the City of Portland must first make it available to them. The structure is not needed for public use. Declaring the dock to be surplus and donating it to Gresham will incur no expense for the City of Portland.

4. The Director of Portland Parks and Recreation recommends that the abandoned steel loading dock at Linnemann Junction along the Springwater Corridor be declared surplus and the item transferred to the City of Gresham for its disposition.

 NOW THEREFORE, the Council directs:

 a. The abandoned loading dock at Linnemann Junction in Gresham is declared surplus.

b. The Commissioner of Public Utilities is authorized to execute a document transferring ownership of the loading dock to City of Gresham and authorizing its removal from the City of Portland's land.

Section 2. The Council declares that an emergency exists because delay in surplusing the dock and authorizing its removal from the Springwater Corridor will delay the City of Gresham's trailhead project at Linnemann Junction; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
