ORDINANCE No. 176844

*Extend Legal Service Agreement with Cable, Huston, Haagensen & Lloyd for Outside Counsel. (Ordinance; amend Contract No. 33228)

The City of Portland ordains:

Section 1. The Council finds:

1.  The City contracted with Outside Counsel to assist in legal matters pertaining to IRNE..

2.  Jim Deason, of Cable, Huston, Haagensen & Lloyd, agreed to provide such services in an original contract amount of $19,500, Legal Service Agreement No. 33228.

3.  Due to the nature of the project and the potential for litigation outside counsel will be required to provide more legal assistance than originally anticipated. Because of these additional responsibilities, it is estimated that an additional $100,000 is required to continue payment for these services, for a total $249,500.

NOW, THEREFORE, the Council directs:

a.  The City Attorney is authorized to extend Legal Service Agreement No. 33228 dated October 18, 2000 to provide for representation by outside counsel in an additional amount of $100,000, for a total amount not to exceed $249,500.

b.  If applicable, the provisions of City Code Chapter 5.68 are waived.

c.  The Mayor and Auditor are authorized to draw and deliver warrants in payment of legal services provided under this Legal Services Agreement

Section 2. The Council declares that an emergency exists in order to pay for legal services necessary in the IRNE matter; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
