ORDINANCE No. 176843
*Approve settlement with Ackerman’s Uniforms. (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The Portland Police Bureau ordered jackets for its Crisis Response Team volunteers from Ackerman’s Uniforms after obtaining competing bids. Although adequate competition was obtained, the purchase process had some technical flaws.
2. After receiving the jackets a dispute arose over some, but not all, of the jackets and the proper amount of payment.
3. The City Attorney’s Office investigated the dispute and negotiated an appropriate settlement with Ackerman’s Uniforms, subject to Council approval. The settlement includes a discount on jackets over which there was a dispute and full payment on jackets to which there was no dispute. That settlement agreement is attached as Exhibit A.
4. Funds are available for payment of the settlement from Victim of Crime Act (VOCA) grant monies.
NOW, THEREFORE, the Council directs:
a. The Mayor, as Commissioner of Public Safety, is authorized to execute the proposed settlement agreement with Ackerman’s Uniforms in substantially the same form as shown on the attached Exhibit A.
b. When executed by both parties, the Police Bureau is authorized to issue a check chargeable to Center Code 10079388.
Section 2. The Council declares that an emergency exists because a delay in executing the settlement agreement could cause the amount of the proposed settlement to rise; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
