CONSTRUCTION CONTRACT AMENDMENT # 17

AMENDMENT # 17 TO CONTRACT NO. 31987

FOR INVESTIGATION OF BURIED TUNNELS IN HARRISON STREET CONNECTOR RIGHT OF WAY.

Pursuant to Ordinance No. ___________

PARTIES:

 CITY OF PORTLAND, OREGON, OFFICE OF TRANSPORTATION,

 1120 SW Fifth Ave, Portland, OR 97204, by and through its duly authorized

 representatives (City or Owner);

 STACY AND WITBECK, INC., a California Corporation, 1320 SE Water Ave,

 Portland, OR 97214 (General Contractor).

AGREED:

I.  This contract Amendment No. 17 (Amendment # 17) amends Contract No. 31987 (Contract), dated October 20, 1998.

II.  All terms and conditions of the Contract are incorporated into this Amendment by reference.

III.  Under this Amendment # 17 the General Contractor shall furnish all necessary materials, equipment and labor for investigation of the location, depth and other characteristics of the two tunnels in the proposed Harrison Street Connector right of way, as shown on Sheet C109 of the Portland Streetcar RiverPlace Extension and Harrison Connector Project Preliminary Engineering Plans dated July 23, 2002. General Contractor shall coordinate its work with the Project Civil Engineer and Project Manager. The General Contractor shall provide the City’s Project Manager a written summary of the findings from this investigation.

IV.  The Contract Amount for the work associated with this Amendment 17 shall be on a time and materials basis in an amount not to exceed fifteen thousand dollars ($15,000).

V.  The General Contractor shall complete the work by September 15, 2003.

VI.  In consideration of these promises, the City hereby agrees to pay the General Contractor for all work performed under the Contract and Amendment in accordance with the Contract Documents.

VII.  All other provisions of the Contract remain unchanged.
