ORDINANCE No. 176835

 

 

*Amend contract with Stacy and Witbeck, Inc. to provide for investigation of buried tunnels in Harrison Street Connector Right-of-Way (Ordinance; amend Contract No. 31987)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  On September 26, 2001, the City Council passed Ordinance No. 175963 authorizing an amendment to Contract No. 31987 between the City of Portland (City) and Stacy and Witbeck, Inc. (SWI) to provide pre-construction services during the preliminary engineering of Portland Streetcar RiverPlace Extension (Project), at no cost to the City.

2.  One of the existing conditions within the Project limits is the presence of underground tunnels that once were part of the freeway connections to Harbor Drive, which was abandoned and reclaimed as Waterfront Park.

3.  The exact location and contents of the tunnels are not precisely known, both aspects of which will have a significant impact to the cost constructing the Harrison Street Connector.

4.  The City desires to obtain more information about the tunnels during the engineering phase of the project so that this critical information can be incorporated into the final design and has asked SWI to propose a plan for investigation.

5.  This work is beyond the services called for in pre-construction review and the City desires to compensate SWI on a time and materials basis in an amount not to exceed $15,000 for the work.

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner of Public Utilities and the City Auditor are hereby authorized to enter into an amendment with Stacy and Witbeck, Inc., substantially in accordance with the amendment attached to the original of this Ordinance, and by reference made a part hereof.

b.  The Mayor and the Auditor are hereby authorized to draw and deliver checks payable to Stacy and Witbeck, Inc., chargeable to the Transportation Operating Fund, AU 159, Object Code 210.

Section 2.  The Council declares that an emergency exists because a delay will interfere with the City’s ability to finalize the engineering of the Project; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
