ORDINANCE No. 176807

 

* Authorize a contract with the State of Oregon, Oregon Department of Transportation for Springwater Corridor Three Bridges (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  By the authority granted on ORS 190.110, 3666.770 and 366.775, the State may enter into cooperative agreements with local agencies for the performance of work on certain types of improvement projects with the allocation of costs on terms and conditions mutually agreeable to the contracting parties.

2.  Portland Parks & Recreation and Metro have been jointly working to implement the Springwater Corridor between SE 17th Ave and Ochoco St and west of the Union Pacific Railroad where the existing Springwater Corridor currently ends. Design work is ready to begin.

3.  Transportation Equity Act of the 21st Century (TEA-21) funding has been approved by ODOT in the amount of $4,209,000. Staff has arrived at a Local Agency Agreement, substantially similar to that herein attached as Exhibit A to this ordinance, with ODOT for the performance of work on the Springwater Corridor Three Bridges improvements.

4.  Local match is required by the conditions attached to the funding. Match is committed through the $450,000 from Park’s and $28,700 from the City of Milwaukie. Metro’s financial participation in the Three Bridges Improvements is provided through purchase of the land on which the project will be constructed.

NOW, THEREFORE, The Council Directs:

 

a.  The Commissioner-in-Charge of Portland Parks and Recreation is authorized to execute the Local Agency Agreement No. 19484, substantially similar to that attached hereto as Exhibit A, with the Oregon Department of Transportation in order to allow the performance of work on the Springwater Corridor Three Bridges.

 

Section 2.  The Council declares an emergency exists because of the need to use allocated funds work must commence immediately to complete the project and allow the use and enjoyment by the public; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
