ORDINANCE No. 176794
*Extend agreement with Merina & Company, LLP for consultation services (Ordinance; amend Contract No. 34075)
The City of Portland ordains:
Section 1. The Council finds:
1. Due to the nature of litigation and the time constraints imposed by the court, the City required the immediate services of expert witnesses to assist in the matter of City v. Boeing and Cascade, USDC Civil Case No. 99-1761.
2. Merina & Company agreed to provide consultation services to the City Attorney’s Office about the Water Bureau’s Overhead methodology and to provide expert reports and testimony by Agreement No. 34075, for a total authorized amount of $20,000.
3. Due to the complexity of the issues and the magnitude of the case, it is necessary to increase the authorized amount of this agreement in the amount of $10,000 to complete the work.
4. The City Attorney’s Office may change the consultant’s scope of work depending on the services required and increase the amount of compensation due to the contractor by an amount not to exceed 25% without further Council action.
NOW, THEREFORE, the Council directs:
a. The City Attorney is authorized to extend Agreement No. 34075, dated January 22, 2002, to provide for expert consultation services in an additional amount of $10,000 for a total authorized amount of $30,000.
b. If applicable, the provisions of City Code Chapter 5.68 are waived. The City Attorney’s Office is authorized to execute amendments to the contract in an amount not to exceed 25% of the total contract price.
c. The Mayor and Auditor are authorized to draw and deliver checks in payment of expert services provided under this Agreement chargeable to Center Code 18089961/ Project No. 3457/Account No. 521000.
Section 2. The Council declares that an emergency exists in order to obtain the expert advice and services required for the City v. Boeing and Cascade litigation; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
