ORDINANCE No. 176788
*Authorize Intergovernmental Agreement and execution of easement with the Willamette Shore Line Consortium for construction of the SW Parallel Interceptor Segment 2 (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Environmental Services is engaged in a program to control combined sewer overflows (CSOs) that currently reach the Willamette River.
2. The Bureau needs to acquire easements for the construction of the next major phase of the program known as the SW Parallel Interceptor Segment 2.
3. The Willamette Shore Trolley Consortium has agreed to grant easements to the Bureau of Environmental Services necessary to complete this phase of the program.
4. The City of Portland Office of Transportation is a member of the Consortium.
5. The current Intergovernmental Agreement for the Consortium names Portland as the title-holder for the benefit of the Consortium.
6. The City of Portland should now authorize the execution of the easement and Intergovernmental Agreement documents.
NOW, THEREFORE, the Council directs:
a. The Director of the Office of Transportation is authorized to execute the Intergovernmental Agreement and easement attached hereto.
c. The Director of the Bureau of Environmental Services is authorized to execute the Intergovernmental Agreement, accept the easement and pay the consideration of $306,248.
d. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand for payment is presented by the Consortium.
e. That the Right-of-Way Acquisition Section, Transportation Engineering and Development shall record in the appropriate deed records, documents of title as necessary for acquisition of the easement.
Section 2. The Council declares that an emergency exists because a delay in the execution of the easement might result in delays in the construction of the project; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
