ORDINANCE No. 176302 AS AMENDED

 

*Authorize implementation of Human Resources Administrative Rules, repeal the Personnel Rules, repeal existing Human Resource Policy Resolutions and Ordinances, and amend the City Code to reflect changes. (Ordinance; amend City Code Section 3.15.050, Repeal Chapters 3.57, 3.58, Title 4 and Section 5.08.100, Repeal Resolution Nos. 35757 and 34849 and Ordinance Nos. 171144, 172881, 172880, 173221 and 173145; and Amend Ordinance No. 166997).

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  Over the past several years a number of assessments have been performed on the City’s Human Resources system and they have generally reached the same conclusions:

 

•  The Charter and the City’s personnel policies have not kept pace with the changing dynamics of the workforce and the business needs of the bureaus.

 

•  No individual or group is responsible for personnel policy development, implementation, dissemination or communication.

 

•  There is no single, comprehensive data base, manual or collection of human resources policies, creating inconsistent application of policy and inequities in how human resources issues are addressed throughout the City.

 

•  There are no standards of accountability for managers to ensure actions are consistent with Citywide human resources policies.

 

•  Human resources policy is often made in response to a crisis, rather than as a strategic activity.

 

2.  In early 2000, the Bureau of Human Resources began a policy audit to identify existing Citywide and bureau specific policies, gaps in policies and/or outdated policies.

 

3.  The Administrative Services Review process confirmed the findings of the Human Resources Assessments and the Policy Audit, and a Policy Committee was convened to develop Citywide Human Resources Administrative Rules.

 

4.  The draft rules were circulated to Council, bureau managers, Citywide human resources staff and labor leaders in August 2001.

5.  The draft rules were revised to incorporate feedback from the August review and were redistributed for review and comment in October 2001 to Council, bureau managers, Citywide human resources staff, labor leaders and City employees. Additionally, informational meetings were held in December 2001.

 

6.  A 15-day notification of a change to the Personnel Rules was provided to each member of the City Council, all bureau managers and each labor organization representing City employees.

 

7.  Revisions are necessary to Chapter 3.15.050 to establish and clarify the duties, responsibilities and authority of the Director of the Bureau of Human Resources.

 

8.  The provisions of Chapter 3.57, Industrial Injury Return to Work Policy, are contained in the Human Resources Administrative Rules and no longer need to reside in the City Code.

 

9.  The provisions of Chapter 3.58, Vehicle Loss Control Policy, are contained in the Human Resources Administrative Rules and no longer need to reside in the City Code.

 

10.  The provisions of Title 4, Personnel, are contained in the Human Resources Administrative Rules and in the recommended amendments to Section 3.15.050 of the City Code; therefore, Title 4 is no longer necessary.

 

11.  The provisions of Section 5.08.100, Rules for Travel and Miscellaneous Expenses, are contained in the Human Resources Administrative Rules and no longer need to reside in the City Code.

 

12.  Existing resolutions and ordinances which govern Gender Identity, AIDS in the

Workplace, Use of City Telephones, Use of City Resources, Inclement Weather,

Workplace Violence and Catastrophic Leave are superseded by the Human

Resources Administrative Rules.

 

13.  Ordinance No. 166997, passed by Council on September 29, 1993, adopted a Drug and Alcohol Policy, which is contained in the Human Resources Administrative Rules.

NOW, THEREFORE, the Council directs:

 

a.  PCC Section 3.15.050, Bureau of Human Resources, is amended in accordance with Exhibit A, effective April 5, 2002.

 

b.  PCC Chapters 3.57, Industrial Injury Return to Work Policy, and 3.58, Vehicle Loss Control Policy, are repealed in accordance with Exhibit A, effective April 5, 2002.

 

c.  PCC Title 4, Personnel, is repealed in its entirety in accordance with Exhibit A, effective April 5, 2002.

 

d.  PCC Section 5.08.100, Rules for Travel and Miscellaneous Expenses, is repealed in accordance with Exhibit A, effective April 5, 2002.

 

e.  The Personnel Rules are hereby repealed effective April 5, 2002.

 

f.  The Human Resources Administrative Rules, attached hereto as Exhibit B, are effective April 5, 2002.

 

g.  The following Resolutions and Ordinances are hereby repealed effective April 5, 2002:

 

•  Resolution No. 35757 – Gender Identity

•  Resolution No. 34849 – AIDS in the Workplace

•  Ordinance No. 171144 – Use of City Telephones

•  Ordinance No. 172881 – Use of City Resources

•  Ordinance No. 172880 – Inclement Weather

•  Ordinance No. 173145 – Workplace Violence

•  Ordinance No. 173221 – Catastrophic Leave

 

h.  Ordinance No. 166997, passed by Council on September 29, 1993, is amended to repeal the Drug and Alcohol Policy portion of Exhibit A.
