ORDINANCE No. 176763

*Amend contract with Thomas/Wright, Inc. to extend the term of the agreement to December

31, 2002 for services to the Fanno Basin Pump Station, Project No. 5761

(Ordinance; amend Contract No. 30824)      

The City of Portland ordains:

Section 1. The Council finds:

1.  The Bureau of Environmental Services (BES) has need of continuing engineering services provided by Thomas/Wright, Inc for the completion of design and construction support services related to the Fanno Basin Pump Station that were authorized in Amendment No. 4 to contract 30824.

2.  Consultant is performing engineering services under Contract No. 30824, executed in September 1996, with an amended expiration date of June 30, 2002.

3.  There is no need to amend the current contract amount. Funds are available in the Adopted Sewer System Operating Fund, FY 2002-03 Budget, Bureau of Environmental Services, Center Code 145-22-110 Project Number 5761, Account No. 521000.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Affairs and Auditor are authorized to extend the time for completion of amended contract 30824 with Thomas/Wright, Inc. to December 31, 2002 for the purpose described in Section 1.

b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Adopted Sewer System Operating Fund, FY 2002-2003 when demand is presented and approved by the proper authority.

Section 2: The Council declares that an emergency exists because the continued service of the consultant are required to complete design and construction support services authorized in Amendment No. 4 to PTE contract No. 30824 which will not be completed before the current contract expiration date. The delays have been outside the control of the consultant. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
