ORDINANCE NO. 176700
*Authorize maintenance agreement and first amendment with the Tri-County Metropolitan Transportation District and Portland State University for a Bus Transit Center (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. In February 1999, the City of Portland passed Ordinance No. 173066 which adopted an agreement with the Tri-County Metropolitan District (Tri-Met) and Portland State University (PSU) for a bus transit center at PSU.
2. That work is now complete.
3. An Intergovernmental Agreement (IGA) and first amendment to cover the maintenance of the various elements of the PSU Bus Transit Center has been proposed between Tri-Met, PSU and the City.
4. The City Attorney's Office and appropriate other City staff have reviewed and approved the prepared agreement and first amendment.
5. The City should now approve the agreement and first amendment, and execute the same.
NOW, THEREFORE, The Council directs:
a. The Commissioner of Public Utilities and the City Auditor are hereby authorized to approve and execute on behalf of the City of Portland, the "Intergovernmental Maintenance Agreement and First Amendment" between the City of Portland, Portland State University and the Tri-County Metropolitan Transportation District of Oregon for a Bus Transit Center at PSU, substantially in conformance with the attached Exhibits A and B, and and by this reference made a part hereof.
Section 2. The Council declares that an emergency exists because delay in executing this agreement could cause delay in maintenance of certain elements of this project; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
