ORDINANCE No. 176697

 

*Agreement for cooperative assistance during emergency conditions with the Oregon Department of Transportation and others (Ordinance)

 

The City of Portland Ordains:

 

Section 1. The Council finds:

 

1 .  That State Law (ORS Chapter 401.480, and ORS Chapter 190) provides for collaboration among public and private agencies.

 

2.  That such collaboration is common in the law enforcement and in fire service.

 

3.  That such collaboration between public works agencies could be of significant value in response and recovery operations in an emergency.

 

4.  That such collaboration in public works has been in place among the governments in Multnomah County for five years and thus needs to be renewed.

 

5.  That such collaboration is in the tradition and public interest of the Portland Metropolitan area and should be developed and expanded.

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner and Auditor are authorized to execute a Public Works Cooperative Assistance Agreement, attached as Exhibit A and

 

b.  That this agreement supersedes Agreement No. 50999, dated February 4, 1998 (Ordinance No. 171867), Agreement No. 28302, dated October 14, 1992 (Ordinance No. 165883, and No. 26840, dated January 30, 1991 (Ordinance No. 163828).

 

c.  That the Public Works Cooperative Assistance Agreement be a non-exclusive agreement and that other agencies be encouraged to become parties to it.

 

Section 2. The Council declares that an emergency exists because a delay in proceeding with this agreement could deprive the City of available assistance in the event of an emergency; therefore, this ordinance shall be in force and effect from and after its passage by the Council.
