ORDINANCE No. 176686

 

*Authorize the Director of the Bureau of Environmental Services to execute legal agreements for implementation of stormwater management demonstration projects at two Portland Public Schools (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  That on April 11, 2001 City Council approved Ordinance 175469, authorizing the Director of the Bureau of Environmental Services to execute individual agreements for stormwater management demonstration projects, not to exceed $400,000 in aggregate through December 31, 2002.

 

2.  This ordinance is required in order to allow the Director of the Bureau of Environmental Services to execute agreements for stormwater management demonstration projects at two Portland Public Schools. The first agreement is to implement a project in partnership with Keepers of the Waters for the Northwest at the Da Vinci Middle School. The second agreement is to implement a project in partnership with Portland Bureau of Parks and Recreation at Glencoe Elementary School.

 

3.  This ordinance is needed because both agreements contain substantive deviations from the form of agreement previously approved by Council in Ordinance 175469.

 

4.  Both of these projects meet the requirements and criteria of the Willamette Stormwater Control Program for selection as demonstration projects.

 

5.  Portland Public Schools reviewed and approved both of these projects in June 2002.

 

6.  Th established cost of these two projects is $95,000. Funds are available in the Sewer System Operating Fund, FY’02/03 Budget, Bureau of Environmental Services, Center Code 14532040.

 

 

NOW, THEREFORE, the council directs:

 

a)  The Director of the Bureau of Environmental Services is authorized to execute the two aforementioned agreements, consistent with the requirements of Ordinance 175469.

 

b)  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

 

c)  The agreements executed pursuant to the authority delegated by this Ordinance shall provide a payment of $30,000 for the Da Vinci School Project and $65,000 for the Glencoe School Project. Any participation by the City above these amounts must be approved separately by the Council.

 

d)  The agreements authorized by this Ordinance shall be in substantial conformance with the agreements attached hereto as Exhibit A & B, both of which have been reviewed by the City Attorney’s Office.

 

Section 2.  The Council declares that an emergency exists because these agreements are necessary to the completion of the two projects by December 31, 2002. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
