ORDINANCE NO. 176674

*Amend the fee schedule for land division applications, demolition delay applications, and other miscellaneous planning services charged by the Office of Planning and Development Review effective July 5, 2002 (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  Effective July 1, 2002, Title 33, Planning and Zoning, is being amended to include new processes for land divisions as adopted by Ordinance numbers 175965 and 176333.

2.  The existing land division and other related fees need to be eliminated and new land division and other related fees need to be adopted to reflect the new regulations and processes.

3.  Effective July 20, 2002, Title 33, Planning and Zoning is being amended to include new processes for historic landmarks as adopted by Substitute Ordinance 176587.

4.  Fees for demolition delay extension review need to be added to the Land Use Review Fee Schedule.

5.  These new land use review fees should take effect on July 5, 2002 in order to be closely coordinated with the effective dates of the new Title 33 provisions.

6.  Unless separate Council action is taken, these land use review fees will automatically be adjusted annually according to the consumer price index in similar practice with the other land use review fees.

NOW THEREFORE, The Council directs:

a.  The fees listed in Exhibit A to this ordinance will be effective July 5, 2002.

b.  The fee schedule attached as Exhibit A shall be adjusted annually in accordance with the provisions of Ordinance 164184 which provides for adjustments in the Bureau’s fee schedule based upon increases in the consumer price index.

Section 2.  The Council declares that an emergency exists in order to enact fees corresponding to the new land division provisions of Title 33, Zoning Code; therefore this ordinance shall be in full force and effect from July 5, 2002.
