* Agreement with Portland Community Land Trust for $102,300 for the Portland Community Land Trust acquisition and provide for payment. (Ordinance)

The City of Portland ordains:

SECTION 1. The Council finds that:

1.  The City is entitled to receive federal Community Development Block Grant (CDBG) funds to carry out a number of community development activities.

2.  The City’s Bureau of Housing and Community Development is primarily responsible for the planning and administration of the CDBG funds and related program development.

3.  The Portland Community Land Trust (PCLT) is a nonprofit community-based, membership organization established to acquire property and retain affordable housing opportunities for lower income people.

4.  The City has committed to provide funding resources to the Land Trust and resources are available as budgeted in the FY2002-2003 housing and community development budget.

5.  The City now wishes to enter into an agreement in the amount of $102,300 with the Portland Community Land Trust to acquire properties and retain affordable housing opportunities for lower income households under the land trust model.

NOW, THEREFORE, the Council directs:

a. The Commissioner of Public Works is hereby authorized to enter into an agreement with Portland Community Land Trust for the Portland Community Land Trust to acquire and retain affordable housing opportunities for lower income households in accordance with the agreement attached as Exhibit A (attached to original ordinance only).

b. The Mayor and City Auditor are hereby authorized to pay for said contract from the Housing and Community Development Fund.

Section 2. The Council declares that an emergency exists because delay in funding would interrupt Portland Community Land Trust's ability to acquire permanently affordable housing; therefore, this ordinance shall be in force and effect from and after its passage by Council.
