ORDINANCE No. 176645

 

* Authorize the execution of lease documents with Sulzer Pumps U.S., Inc. for office, shop and

yard space for the West Side Combined Sewer Overflow Project (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The Bureau of Environmental Services is engaged in a State-mandated program to control combined sewer overflows (CSOs) that currently reach the Willamette River. As part of this program, work is about to commence on the Westside CSO Projects with completion required by December 2006.

 

2.  The Bureau’s project team requires a suitable construction office with yard and shop space in close proximity to the project’s pivotal work site and staging area, known as the Nicolai Shaft.

 

3.  Sulzer Pumps (US) Inc. has, as a portion of their property at 2800 NW Front Ave, an available building with shop and yard space that meets the Project’s requirements and is immediately adjacent to the Nicolai Shaft site.

 

4.  Sulzer Pumps (US) Inc. has agreed to lease this portion of their property to the Bureau of Environmental Services at competitive rates for the area.

 

5.  The estimated cost for the term of the Lease is $1,013,617.00. Funds are available in the Sewer System Operating Fund, FY 2002-2003 budget, Bureau of Environmental Services, Center Code 14522110, Project No. 6680, Acct. Code 544000.

 

NOW, THEREFORE, the council directs:

 

 a.  The Director of the Bureau of Environmental Services is authorized to execute a lease between Sulzer Pumps (US) Inc., lessor, and the City of Portland, substantially the same as the attached Exhibit A, for a portion of the property at 2800 NW Front Ave, Portland, Oregon, as defined in the exhibit, and said agreement has been approved by the City Attorney.

 

 b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants for lease rent chargeable to the Sewer System Operating Fund Budget for the duration of the lease term.

 

Section 2.  The Council declares that an emergency exists because failure to execute the lease in a timely manner may result in loss of the necessary space currently available or could delay project implementation creating a hardship on the Bureau of Environmental Services. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
