ORDINANCE No. 176644

* Appropriate funding for contract with Mayes Testing Engineers, Inc. for overflow materials testing, special inspection, and engineering services for the Materials Testing Laboratory for FY 2002/2003. (Ordinance)

The City of Portland ordains:

Section 1.  The Council finds:

1.  Ordinance No. 174791, passed August 23,2000, authorized Contract No. 33109 with AMEC Earth & Environmental, Inc. (formerly AGRA Earth and Environmental) for outside personnel services to provide overflow materials testing, inspection, and engineering services on City of Portland construction projects. This contract has been transferred to Mayes Testing Engineers Inc. as allowed in the provisions of the contract and approved by City of Portland Attorney’s Office.

2.  The Bureau of Environmental Services has need to appropriate funds for this contract for FY 2002/2003.

3.  Funds are reflected in the Sewer System Operating FY 2002-2003 Adopted Budget, Bureau of Environmental Services, Center Code 145-37-071, Account No. 521000.

NOW, THEREFORE, the Council directs:

a.  The Mayor and Auditor are authorized to appropriate funding for the purpose described in Section 1, in the amount of $416,670.

b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants payable to Mayes Testing and chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

Section 2.  The Council declares that an emergency exists because a delay in approving this ordinance would result in a lack of source for these services to the City. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
