ORDINANCE No. 176642
*Authorize Interagency Agreement with the Portland Development Commission for 2002-2003 professional and technical services for transportation improvements (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City of Portland (City), in partnership with the Portland Development Commission (PDC), are implementing transportation improvements within the designated urban renewal districts.
2. The City and PDC, under their respective charter authorities, are authorized to enter into cooperative agreements for the improvement of communities and environments.
3. PDC desires to use the professional and technical services of the Portland Office of Transportation to plan, design, and construct transportation infrastructure improvements in urban renewal districts.
NOW, THEREFORE, the Council directs:
a. The Commissioner of Public Utilities and the Auditor are hereby authorized to negotiate and execute an Interagency Agreement, similar in form to the agreement attached to the original of this Ordinance, and by this reference made a part hereof.
b. The City project manager is authorized to agree to and execute on behalf of the City, any amendment, which does not increase the total compensation under this agreement or change the length of the contract period with the mutual consent of the PDC contract manager.
Section 2. The Council declares that an emergency exists because a delay in executing this Interagency Agreement will adversely impact the City’s ability to meet the design and construction schedule for the included projects; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
