ORDINANCE No. 176637

•  Contract with Nike, Inc., and Portland Parks Foundation to renovate and resurface outdoor basketball courts (Ordinance)

The City of Portland ordains:

Section 1. The Council finds that:

1.  The Portland Parks & Recreation maintains outdoor basketball courts in all City-owned parks. Many are in a poor state of repair; some are even unplayable.

2.  Nike, Inc. desires to gift the funds necessary to resurface courts in 35 City-owned parks to the Portland Parks Foundation. The new surface is a world-class soft surface, made from ground-up tennis shoes.

3.  Howard S. Wright Company General Contractor, Ace Surfaces, Inc. and Thompson Vaivoda and Associates Architects Inc. have agreed to donate a substantial amount of labor for the completion of this project.

4.  The Portland Parks Foundation has agreed to accept and distribute the funds necessary to complete this project.

NOW THEREFORE, the Council directs:

a.  The Commissioner-in-charge of Portland Parks & Recreation is authorized to sign an agreement with Nike, Inc., and the Portland Parks Foundation accepting the resurfacing of outdoor basketball courts in 35 City-owned parks, substantially in agreement with the attached exhibit.

Section 2. The Council declares that an emergency exists because the surfacing can only be done during the dry summer months; therefore, this Ordinance shall be in full force and effect after passage by Council.
