* Amend contract with Pacific Coast Construction to provide emergency soil stabilization and emergency structural corrections at Hillside Community Center (Ordinance: amend Contract No. 32888)
The City of Portland ordains:
Section 1. The Council finds:
1 Portland Parks and Recreation [PP&R] applied for and received a grant of $150,000 from the Oregon Community Foundation [I-405 Fund] to construct a new multi-purpose classroom at Hillside Community Center; the grant to be disbursed in two equal payments. The first payment was released this year with the purpose of verifying suitability of the site and to conduct soil testing, as the proposed building site is noted for unstable soils and expandable clay deposits.
2 Soil test-bores were conducted during May 2002 but proved inconclusive in verifying subsoil conditions. Additional test pits were dug, leaving the area pitted with 5-foot deep holes and an unstable “cut” into the hillside, both posing a hazard for preschool children that attend Hillside CC and adult users.
3 PP&R staff and one of the City Architects have determined that the unstable soils must be removed, that the holes be filled and a retaining wall be placed immediately to avoid further accidents before the building project, proper, commences later this year.
4 Pacific Coast Construction [PCC] is currently under contract to the City renovating University Park Community Center [Ordinance No. 175713], and has had an exceptional record renovating facilities during continued occupancy. PP&R and the City Architect requested PCC to expand its current work by organizing the soil stabilization project and administering a public safety plan. Due to extreme safety concerns, work was commenced on Saturday, June 8 and will be complete by Friday, June 28, by which time the above safety requirements will be met, and a concrete slab will be poured thereby restoring safe conditions to the site and leaving the site ready for above-ground construction in the near future.
5 Due to the urgency of safety issues and the uncertainty of site work to be accomplished, PCC was able to develop a guaranteed maximum price [GMP] concurrent with the work, but not before commencing the work. The GMP for the site stabilization work as of June 24 has been determined to be $77,000.
NOW, THEREFORE, The Council Directs that:
a. The Bureau of Parks and Recreation is hereby authorized to amend Contract No. 32888 with Pacific Coast Construction, Inc. to include the additional scope of work, bringing the total to a Guaranteed Maximum Price of $1,683,234.
b. The Mayor and Auditor hereby are authorized to provide for payment chargeable to the applicable budgets when demand is presented and approved by the appropriate authorities.
c. To facilitate any remaining change orders, the project manager is authorized to increase the adjusted value of the Contract by no more than 25%, without requiring additional Council approval.
Section 2. The Council declares an emergency exists due to a need to resolve hazards to the users of Hillside Community Center; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
