ORDINANCE No. 176626

*Pay claim of Aleksey Gossen. (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  Aleksey Gossen through his attorney has filed a Bodily Injury Claim against the City for damages suffered in a motor vehicle accident between a Portland Police bureau Reserve Officer and Aleksey Gossen on March 24, 2001.

2.  The claim has been investigated by the Risk Management Division. Investigation indicates there is risk the City may be found liable. Therefore, in order to avoid the risk of a large jury award, it is prudent to compromise the Bodily Injury Claim at this time.

3.  The Risk Management Division recommends the Bodily Injury Claim be compromised for $45,000, subject to the claimant providing the City with his release in a form to be approved by the City Attorney..

NOW, THEREFORE, the Council directs:

a.  The Mayor and the Auditor are hereby authorized to draw and deliver a check in the amount of $4,265.35 made payable to Legacy Emanuel Hospital, and another check in the amount of $40,734.65 made payable to Aleksey Gossen and Ron Sayer, Attorney. Total claim settlement is $45,000.

b.  The Risk Management Division will execute a payment authorization in the amount set forth in sub-paragraph (a) above.

Section 2. The Council declares that an emergency exists in order to avoid undue and costly delay in settling this Bodily Injury Claim; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
