ORDINANCE NO. 176399
*Authorize application to U.S. Environmental Protection Agency for a grant in the amount of $115,000
to develop a water system Security Vulnerability Assessment, Emergency Operations Plan, and
security enhancements plans and designs (Ordinance).
The City of Portland ordains:
Section 1. The Council finds that:
1. The House of Representatives is currently reviewing H.R. 3448, a bioterrorism bill that contains provisions requiring all drinking water systems serving at least 3,300 people to conduct vulnerability assessments and update emergency response plans.
2. After September 11, 2001 the US Environmental Protection Agency (US EPA) received a supplemental appropriation to improve the safety and security of the Nation’s drinking water systems.
3. With this supplemental appropriation, the US EPA developed a grant program for drinking water utilities to develop Vulnerability Assessments, Emergency Operations Plans, and to plan and conduct preliminary design for security enhancements to enhance their ability to respond to emergency situations.
4. Conditions of the grant require that Vulnerability Assessments be completed by end of calendar year 2002.
5. The grant is being offered to all publicly owned water utilities that serve water to more than 100,000 people.
6. The $115,000 grant does not require matching funds.
NOW THEREFORE, The Council directs:
a. The Mayor is authorized to make application to the US Environmental Protection Agency for a grant in the amount of $115,000 by April 29, 2002.
b. The Mayor is authorized to provide such information and assurances as are required for the grant period.
Section 1. The Council declares that an emergency exists since the application must be submitted by April 29, 2002; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
