ORDINANCE No. 176390

*Amend End User License Agreement with NextBus Information Systems, Inc. for equipment and services to provide real-time arrival information for Portland Streetcar (Ordinance; amend Contract No. 51688)

The City of Portland ordains:

Section 1. The Council finds:

1.  On October 31, 2001, City Council passed Ordinance No. 176036 authorizing an agreement with NextBus Information Systems, Inc. for the equipment and services needed to provide real-time arrival information for Portland Streetcar.

2.  On March 22, 2002, the system, know as Streetcar Arrival Time, became active.

3.  As part of the original contract, seven (7) tracker suites, the collective name for the equipment on the vehicles needed to operate the system, were purchased for the seven (7) Inekon/Skoda streetcar vehicles.

4.  It has been determined that one element of the tracker suites, the mobile data terminal, may be deleted from the package with no adverse impact on the performance of Streetcar Arrival Time.

5.  Portland Streetcar desires to have the same tracker suites, less the mobile data terminal, installed on the two Vintage Trolleys operating on the Portland Streetcar system.

6.  The Portland Office of Transportation has negotiated with NextBus Information Systems, Inc. to obtain a quote to add two additional tracker suites and 5-year operation services and to credit the project for the twelve (12) mobile data terminals not installed for a net increase to the contract of $3,490.00

NOW, THEREFORE, the Council directs:

a.  The City Engineer is hereby authorized to approve the Change Order to Contract No. 51688, attached to the original of this Ordinance, and by reference made a part hereof.

b.  The Mayor and the Auditor are hereby authorized to draw and deliver checks payable to NextBus Information Systems, Inc., chargeable to the Transportation Operating Fund, AU 159, Object Code 210.

Section 2. The Council declares that an emergency exists because a delay in proceeding will impair the ability to provide reliable service information for all of the vehicles operated by Portland Streetcar; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council
