ORDINANCE NO. 176347

 

* Amend Intergovernmental Agreement with the City of Gresham, Oregon for participation in the Portland HOME Consortium and provide for payment. (Ordinance; Amend Agreement No. 33903)

 

The City of Portland ordains:

 

Section 1. The Council finds that:

 

1.  The Portland HOME Consortium is the recipient of funding under the U.S. Department of Housing and Urban Development HOME Investment Partnership Program (authorized by Public Law 101-625, Title II, November 26, 1990) for the development of affordable housing for low and moderate income households.

 

2.  As the lead agency of the Consortium, the City of Portland is responsible for contracting program funds to implementing agency.

 

3.  In accordance with the HOME Consortium Agreement (No. 50305), a portion of the HOME grant is attributable to Gresham's participation in the Consortium, and Gresham is entitled to plan for the expenditure of such funds.

 

4.  The City of Portland and the City of Gresham have entered into Agreement No. 33903 to allocate HOME funds under the HOME Consortium Agreement to the City of Gresham for FY 2001-02. There remains in the City’s Housing and Community Development Budget $809,619 in HOME funds allocated to the City of Gresham for FY 2000-01 but not expended.

 

5.  The City desires to amend Agreement No. 33903 by adding these unspent HOME funds in the amount of $809,619.

 

NOW, THEREFORE, the Council directs:

 

a. The Commissioner of Public Works is hereby authorized to enter into an Agreement to Amend Agreement No. 33903 with the City of Gresham in a form substantially in accordance with the agreement attached as Exhibit A (attached to original ordinance only).

 

b. The Mayor and City Auditor are hereby authorized to pay for said contract from the HOME Fund.

 

 

Section 2. The Council declares that an emergency exists because delay in funding would interrupt the City of Gresham’s ability to provide affordable housing under its HOME Program; therefore, this ordinance shall be in force and effect from and after its passage by Council.
